Is there anyone I can contact to find out if I am likely to be granted residency before I fork out 500 pounds thats non-refundable. Drink driving convictee.
I am a 43 year old Telecom Eng looking to move to NZ . I have deciede to complete a recognised course there as a student. I have convictions from my past 4 in all 2 for theft, Fines (Lead off a roof and a car wheel). 1 for assault (wounding, in a fight I cut a lads mouth 140hours community service) ,and 1 for distubing the peace(bound over no fine). These all occured over 20 years ago. I was 18 when I was charged with assault.Is this a point blank refusal as I have declared them on my application. Now they have asked to see my PNC records. I have been granted a Security Clearence certificate by the Home Office as I work in a restricted enviroment, would this be of any advantage. Any comments would be appreciated .Thanks.
I was the person convicted of drink driving in NZ about a year ago, I dont have any previous convictions, just a couple of speeding fines in the last few years also in NZ. Do you know if the drink driving conviction considered a criminal conviction or a traffic offence and do I need to declare it on my application?
Hi, how do you find out if a caution is on your record or not? I received a caution a while ago and have been advised by my agent that it will not affect my family's application to emigrate to Australia, but I have noticed on the website that you mention a caution may have an effect if it is on someone's record. I'm just a bit confused - thanks.

My Family and I are very interested in moving abroad to New Zealand or Australia, but I have a criminal record dating back to 1996. I served 15 months of a 30 month sentence which was related to stolen property and possession of cannabis. It has been almost 10 years but after visiting some of the discussion boards on the Internet, it looks as if he would be refused point blank on the above grounds, probably have major problems trying to obtain even a visitors visa. Please could you let me know if there is any chance at all to obtain a visa or would I just be wasting my time? The only positive aspects would be that he is an I.T. Professional (Systems Integration Specialist), We has close family in Australia and we are financially secure and would be willing to financially invest up to $250000 in the country. Would any of this help? If we did get refused would we have a right to appeal? I would be grateful for any comments.

I wondered if this will affect my application for a 12 month working visa?
I want to apply fo permanent residency in NZ under the partnership scheme as my girlfriend is from NZ. We are currently living in my home country. About a year ago while in NZ I was convicted of drink driving. Do you think this will affect my application?
i would like to get a hiv test and a chest xray done before i go to australia in november. the line of work i will be doing doesnt require me to have them done but would like to have the results to show for when i apply for a spouse visa. i am going to use a medical centre thats listed on the government immigration website so it should be valid. would this be sufficient or would i have to get one done when told to by the visa department.

Not really. As a rule of thumb a one off Drink/Drive preferably a long time ago and the only character stain - should be OK for Australia. This is not a blanket refusal case. Every case is considered on its merits. The clearance for security work in the UK holds little or no sway. It is down to an NZ case officer to decide if you are likely to pose a threat of reoffending in NZ. |

It meets the defintion of a "crime" as it is punishable by imprisonment. You definetly need to declare it. |

It depends if the caution is listed on the "penal record check". You are paying your agent - listen to him/her. |

Unlike Canada - Australia does not have a set period of rehabilitation for any type of offendinig. You have to meet the section 501 criteria - that is you must be deemed by a delegate of the Minister of Immigration NOT to be a threat to the Australian community in terms of reoffending. |

I dont agree it would be impossible for you to get a visa with this record. It would be difficult but I have many succesful clients in both Oz and NZ with terms of imprisonment in their past. The other facts you mention regarding having family - do help as this can give you appeal rights. Call Richard Gregan on 0131 625 6906 for further advice. |

Spent convictions do no relate to a Migration application. You must note the conviction onthe application. It should not mean a compulsory refusal in my experience. |

Not 100% certainly. It could have a negative impact if you have similar convictions in the recent past or other factors that makes the deciding officer feel you will be a danger to NZ road users. |

You should really only do the tests when requested to do so by DIMA. The tests are much cheaper in Australia than in the UK. |

A caution is different from a conviction. If it is not on your record then it definetly wont affect your application. If it is on your record then it probably would not - although you would have to bve careful how you explain this to your deciding officer. |
