Questions:
Hi, I got into trouble with a drug abuser at the age of 16. I spent a few years being treated for depression until I had a mental breakdown and was sectioned at 19. after this I was caught shoplifting twice but have no criminal convictions. I stopped receiving medication for any mental health problems over three years ago and have now made a full recovery and a huge change in my life. I am currently studying to become a nurse. Will this affect my application?
I was banned from driving twice many years ago for drink driving. As part of my police check I would imagine this will show up, but other than this I have a clean criminal record. Would this affect my visa application to Australia? The last ban was in 1997, so almost 10 years ago.
I am 37 and plan to marry my American fiance & live in the U.S. once I finish my Hons. degree in 3 years time. However, I have a juvenile police record. I have not been in any trouble for nearly 20 years, and have been a Christian for 12 years. My juvenile record was terrible and includes posession of cannabis, police assault (I kicked a policewoman in a scuffle when she was trying to arrest me for being drunk when I was 17), offensive weapon, criminal damage & some breaches of the peace. The cannabis and cosh were not mine but were found in the back of my car, the other offences were all drink-related as I drank to excess in my teens due to problems at home. Today, I do not drink, and have been a normal mother and law-abiding citizen for years. How will these things affect my visa application almost 20 years on? All but one of my convictions resulted in a fine; the cannabis & cosh resulted in a probation order which was my last offence at 19. Thanks!
Hi, Myself and my wife and 19yr old son (dependents) have just received sponsorship from the South Australian Goverment to migrate there. Howeverlast November my son was pulled over in his car for a random breath test and failed. It was not premeditated as it was the morning after and the result was borderline and dtermined by a blood test. He subsequently received a 9 month ban in April so it will be on his police record required and declared to the DIMIA. We have put character cases together and our migration agent is putting a case together for the Australian visa authorities. Could you please advise if this will ruin our chances of him getting his visa. He has never had any previous offences.
Hi.My husband and 2 children want to emigrate and I am worried about my police check. When I was 14 I was in the wrong place at the wrong time and a group of us was questioned by the police for fighting. In the end we were all blamed for what was in truth a silly arguement that turned a bit nasty. I am not sure if we received a caution as such as I was only 14...I am now 35. It may have just been a stern telling off but I am concerne3d this will show up on the police check. What level of check do you need to emigrate to Canada and if this was to show up would it cause a problem. Many thanks.
my daughter is borderline slow learner her i.q is 70. we had applied for australia can she immigrate with us.we had already send our medical report.
My defacto is currently on the process of applying for permanent residency and will include me in her application as her dependant. I had a drink driving offence last year with medium range PCA. I have a diploma and bachelor degree in business in Australia. The drink driving offence will affect my application? That's the only conviction in my life, I'm 24.

Yes - you will be considered under the "health" criteria to be of a cost to the Australian health community. They will want an expert opinion on whether you are likely to cost them any money. I do not know enough about your case to comment on whether you will be refused. You can call me to discuss this - Richard Gregan - 0131 625 6906 if you like. |

This could be referred to Brisbane. I think it would be harsh if you were refused solely due to the Drink driving events. |

I think your case will be referred to the Brisbane character unit for assesment. On previous experience however I would be surprised if a competently worded submission would not have the case "pass" the character test. Good Luck. |

This level of offending without any significant penalty will not cause you a problem. |

This is genearlly not held out as too high a hurdle to jump in Australia. I would recomend you get some professional representation to make sure. go to www.themara.com.au for your nearest registered agent. |

You need some professional help. 12 months imprisonment in the penalty is an "automatic refusal". This can then be argued with the decision maker in Brisbane. You have got time since last conviction in your favour. I would need more information to give you more detailed advice. |

No - an action has to be raised in this country. If an order is made by the court then it can in throry be enforced in Spain. |
