Questions:
My partner has been in the UK over the last 5 years on work permits. He has been home to Australia approx 4 times in the 5 years for up to 3 month periods. We have lived together for the past 2 years but only have proof (joint bills) for 12 months. I am now pregnant, due in March 2007. What can he apply to stay over here under so he does not have to keep going home and applying for yearly work permits??

I just got married in France to a NZ citizen, we can proove of living together for only 5 months, but we know each other for one year. My husband had to fly back to NZ for work reasons, My daughter and I did apply for a De facto partnership visa 3 weeks ago - we were told it would take 3 weeks and now they did not even check our file and it seems that the issue is uncertain.. I have resigned from my current job in France, I am about to sell my house in France and our flights to NZ with my daughter are for October this year . I am getting real worried about if the issue is negative. NZ immigration service do say and write that they consider applicants too even if they lived together less than 12 months.. What are the alternatives solutions ? we are married and in love with each other, and soon I will be jobless here in France

If by "together" you mean you hve live in a "marriage like" relationship - that is under the same roof for 12 months then you can apply for a "de Facto spouse" visa. |

You are not applying for a defacto marriage visa. You are applying for a marriage visa - as you will have a marriage certificate. The only reasons for refusing your application will be a belief that your marrriage is not genuine or health and character. Good luck. |

you can apply for either a defacto visa - or she could be sponsored by her employer if she has a relevant skill. |

Hello - I did not intend this to be a forum! If the agent you are dealing with at GV is registered with the MARA and offers No VISA No Fee - then he/she will have to jump through some pretty intensive hoops to make this legal! Ask to see the agents registration number. Research this on www.themara.com.au Question the agent as to how many cases like yours he/she has handled. Ask for some past clients you can speak to. If you get on with him/her use them! |

You will have to prove it is a genuine relationship and not contrived for entry into Australia. If this is the case then his newly granted residence gives him the ability to sponsor you. |

You need to get the visa prior to going to America. |

You can apply onshore for a spouse visa (though not a "fiance" visa) If you enter Australia on a tourist visa your intention should be for purpouses of "tourism". I have seen a person turned around at Sydney airport and sent back to the UK because they had a wedding dress in their luggage. |
