Hi. Reference an earlier point regarding my husbands spouse visa: The question that we really need answering, is whether the visa will be valid if used a year after issue, instead of immedietly? (ie, if there is a change of plan).
I am british and my boyfriend is Australian, we met in october 2003 and have flown backwards and forwards to see each other, in April 2005 i came to australia on a WHV and lived with him. I have since returned to the UK as my visa expired in april 2006. We would like to apply for a spouse visa for me but some of the criteria listed was we had to show we had joint financial assets. We do not have joint bank accounts or credit cards and since he had been living at the rental property for 2 years before i moved out there my name isn't on any utility bills or on the rental agreement. Would i still be able to apply for a visa. I spoke to another agent and they told me i wouldn't be granted a visa.
Firstly what an excellent site really informative. My question is: With a 2 year spouse visa. How soon do we need to apply if we are planning on going to Oz in June 07. When does the 2 years start from? Entering the country or when the Visa is granted? If we decided for example to go in 06/08 would we need to apply for a brand new visa and if so would the earlier application complicate matters?
I am a Scottish woman and my partner of one year is oz. We met whilst i travelled and ended up living with him, whilst in oz on a working holiday visa, we have remained together, and he is coming over to the uk on a working visa, at the end of this month. I am also 6 months pregnant with his child and we have disscused that we would both like to return together, once the baby is born. I want to know how eligible iam, how long the process might take, and how much would this cost? the baby is due november 06 and i want to return mid march 07.where do i start? thank you.
My South African boyfriend has been in the UK for 4 years and we have been living together for over 3 years. I am a British citizen and we would like to apply for a defacto visa for him through me to stay in the UK. However he has not had a valid visa to be in the UK for most of the time he has been here. Can we still apply for a defacto visa even though he has been in the UK illegally for the time we have lived together?
I LIVED IN OZ AS DE FACTO THRU MY EX G/FRIEND, I HAVE BEEN LIVING IN THE UK FOR THE PAST YEAR WHERE I HAVE MET A NEW G/FRIEND, SHE HAS NEVER BEEN TO OZ BEFORE BUT I KNOW THIS IS WHERE I WANT TO SETTLE. SHE IN 30 THIS YEAR, SO CAN GET A YEARS WHV. WOULD THIS EFFECT MY DE FACTO IN OZ AS I AM NOT WITH MY EX ??? AND HOW AFTER THE YEAR COULD MY G/FRIEND STAY IN OZ ?? THANK YOU FOR YOUR HELP
MY BOYFRIEND WAS LIVING IN OZ AS DE FACTO, WE NOW LIVE TOGTHER IN THE UK. CAN HE/ WE APPLY FOR IMMERGRATION TO OZ, HE PASSES ON POINTS ( HE'S A WINDOW FITTER) AND I AM A HR OFFICER. DOES IT EFFECT THIS APPLICATION AS HE WAS BEEN DE FACTO BEFORE. THANKS FOR YOUR HELP
My partner is in New Zealand and we ahve been with each other for 2 years and living together almost from the start of our relationship. However, I did not have my bills sent to our address as my parents only live 10 minutes away and so kept the address there so we do not have 1 year of a paper trail. I would like to sponser my partner to stay in this country. How would we go about it?
In the Spouse Sponsorship application form there is a section asking about my ability to provide financial and accomodation assistance for my husband. I have Australian Citizenship however live and work as a nurse in the UK. I do not envisage too many difficulties getting a job or accomodation when I go back to Australia. When we apply for the visa I will not have a job or accommodation in Australia is this likely to have a affect our chances of being succesful in our application?

You would probably need to apply for a "skills" based visa. Check SOL and see if what you do is wanted in Oz.

There are two types of spouse visa. A 309 and a 100. If you get the 309 a years delay. will cause you problems. On the 100 (permanent) you can get around things relatively easily if you dont go straight away.

I am always anxious about contradicting another agent - Your case does seem flawed but not impossible. Call 0131 625 6906.

I recomed applying for the spouse visa about 6 months before you plan to use it. This will save you money in Government and medical fees.

You need a emigration solicitor.

Your status in Australia is unclear. If you are a spose (temporary) (309) then you wont be able to sponsor your new partner. Lots of permutations here - you should get a pro involved.

There would be no bar on him sponsoring you. It is a sponsor under the spouse catergory that has a "2 strikes and your out" type clause, not the sponsee! Window fitter would need to be checked closely re; duties and ASCO and SOL.

You need documentary evidence. That is the basics of all applications. If not bills, then flight tickets, letters, invitations to you both, travel tickets etc etc.

No. Put in where you expect to live, and how you will look for work.
