My boyfriend would like to come and study in Australia for 12 months to study a higher education course. He is from Spain but currently lives in Scotland. He plans to work once university begins-If he gets permission. If we live together for the 12 months and have the necessary papers, could we apply for a defacto visa from Australia so that we could still live together after he has finished studying. Is this still possible if he has worked the maximum of 20 hours per week (with permission)during his stay? Basically can you transfer from a student visa and apply for a defacto visa. We have been together for two years but have not lived together for that period. Many thanks in advance.

What kind of visa can I apply for in order for me to work. Also would i be eligible to get a defacto visa? We are planning to get married in the next couple of years, but do not want to get married just for the sake of geeting a visa. One other thing!! How long does the whole process of getting a visa take, as I want to make sure we have enough time to get it all arranged. Any help would be great! - I am 30 now by the way and he is 27, does that make ant differnce to my visa? Thanks

I am a UK citizen and have been living with my NZ boyfriend in London for 2 years. Would he be eligible for the De Facto Visa? We have had the lease in both our names, and many bills in both names, throughout the 2 years. Plus of course lots of letters and photos of us over the years (we have been together for 4 years - the first 2 of which, I lived in NZ). He is currently in the UK on a Working Holiday Visa. This is about to expire so he will have to leave the country. We figure that we can apply for the De Facto Visa now, and when it is processed, he can return to the UK. What do you think?

Our son has a british passport and we want to get him an australian one. Do we have to go to australia house to get it and what do we need to take with us. Yes, you can transfer from a student to a spouse visa.

You should apply for a spouse visa (defacto - assuming near enough 12 months cohabitation) Takes about 6 weeks in the UK right now.

You can apply for a defacto spouse visa. Age has no bearing on this.

Your son is an Australian citizen by descent. You can apply for this in London. You need a spouse visa. Look at the FAQ's on this site and if you decide you need some help call us for a quote.

If you can prove a relevant qualification you would be better going as an independent skilled migrant in my view. Finding an employer from overseas is do-able but tricky.
