Questions:

We have been informed that probably our best chance of emigrating to Perth, Australia, is through a business visa as we do not qualify as skilled people. We want to know do we have to apply for a business visa first and then buy a business when we leave here and get there and how long does this take, or, do we have to buy a business out there first and then apply for a business visa?
I would like to apply for a fiancee visa to Australia as my fiance is an Australian citizen. However I find he is on a disability pension for the time being owing to his treatment for cancer. His operation is scheduled for March this year and the doctors have assured him of a 90% elimination & cure and after the operation he intends working. He was an accountant and has now completed his realtor course and hopes to seek work in the real estate business. I of course intend continuing working and hope to gain employment in my branch situated in Melbourne.
I have an Auntie in Tasmania but I haven't seen her since I was little (4) 22 yrs approx. My grandparents occasionally talk to her on the phone and I have always received birthday and Christmas cards from her and her family. Would this be enough to sponsor me. For info my Auntie is my Grandad's sister.
My husband applied and received a permanent entry visa to Australia in 1991. He got this because I am an Australian citizen (I was born there), but we came back in 1992. We are now thinking of returning, we are still together, now married and have another child. We have been together for 19 years and married since 1999. Will he have to go through the same procedure as before?
My husband and I want to come to live in Oz on a retirement visa within the next year or so. When we reach the appropriate age in about 3 years time our daughter wishes to sponsor us as aged parents so that we can be permament residents, would coming into Oz on a retirement visa prejudice us in obtaining an aged parents visa. Also can yopu give me some idea of the approximate cost of the health insurance we would need to have in place for a retirement visa and the bond needed for an aged parents visa.
There are plenty of answers for the requirements for emigrating to a new country but are there legal requirements that need to be met before emigration? Eg Are there any official bodies to notify in the UK before emigrating to say New Zealand?

I will be qualifying as a diagnostic radiographer in July 05 and am aware that I have to work 12 months in my profession before being eligible to migrate. Bearing in mind the application process can take 12 - 18 months to process I am wanting to know if I can make my application as soon as I qualify and in advance of having worked 12 months in the profession with a view to my application being accepted in principle and then when I have fulfilled the criteria (of having completed 12 months in the profession) I can then migrate. I am wanting to migrate as soon as possible and wondered if there is any provision for applying early in this respect. If this is not possible is there then a way to speed up my application when I eventually do apply, given the demand for members of the radiography profession? Again if this is not possible, is there a way to work in Australia on a temporary basis whilst my application is being processed? Is there a visa I could get for this purpose? (I am aware that i need to get my qualification assessed by the professional body (AIR) in order to gain employment as a radiographer in Australia).

Purchasing or intending to purchase a business in Australia does not entitle you to migrate to Australia under a business visa category. One of the key criteria is either a requirement to have ownership and management experience in running a qualified business or to be deemed as having management experience at Senior Executive Level.

As your partner is an Australian Citizen he does not require a visa nor pass any medical examinations. You as the applicant must meet medical criteria. The sponsor still needs to meet his sponsorship requirements which include the assistance of his family members, such as providing accommodation and emotional support. His medical situation is not an assessable area within a spouse visa. If anything it will strengthen your application as it will be detrimental to an Australian Citizen if his partner is not allowed to come to Australia. This as you know is not a normal situation for an application. I would advise the use of a knowledgeable migration agent to assist with your application. "

No, eligible family members to sponsor you are limited and you have to be related to them in certain ways. You must be a niece or nephew, unfortunately you are NOT, your mother or father is the niece or nephew, great Aunts cannot sponsor you. Therefore you cannot migrate under the skills migration categories where family sponsorship is required. There may be other migration routes open to you however, so we would recommend filling out our migration assessment form"

Yes he will have to go through the visa application procedure again; however I can assure you the process has changed considerably since you last applied. His permanent residency status would have expired after 5 years. Under the current process he would be granted permanent residency straight away and would avoid going to Australia as a temporary resident for 2 years before obtaining permanent residency. This is due to the length of your marriage and children in your relationship. Once he has lived in Australia for two years he can apply for citizenship and an Australian passport, then you will not have this problem in the future as he will be a dual UK & Aussie passport holder.

Being in Australia on a Retirement Visa will NOT prejudice your aged parent visa. For costs on Health Insurance you will need to contact them directly. It is impossible to give approximate costs as your age and health situation will need to be assessed by the insurance company. There is no bond on the aged parent visa, but on the contributory aged parent visa at present you are looking at a 2nd visa application charge of $26,474 for each applicant and an Assurance of Support Bond of $10,000 for main applicant and $4,000 for 2nd applicant. However if past records prove to be correct you can expect these to rise over the next 3 years. However, it is impossible to advise of the requirements for a visa subclass in three year's time due to constant policy changes.

No there are no official bodies you MUST advise before leaving the UK. But there are obvious things you must do before leaving that are par for the course. Such as cancelling memberships, disconnecting phone/gas/electricity/council tax, advising your accountant/solicitor of your whereabouts and any implications in your personal situation that must be done before leaving the country. If you leave the country owing debts to banks or other organisations then Australia and the UK share information through their federal police at the British Embassy in Australia & Australian Embassy London. Your accountant & solicitor are the best sources however to advise you.

Yes as you where born in Australia whilst your parents where permanent residents you can apply to COPA in London for an Aussie passport and then freely travel to Australia. Your sister will need to meet the general skills migration policy. Your mother can apply for either an ETA or a long stay tourist visa with a maximum stay of six months. Other options for your mother include a retirement visa or Contributory Parent Visa. For a further assessment please contact an OE Consultant."

In order to satisfy a Skilled Migrant Visa the main applicant needs to satisfy the criteria at time of lodgement.
