Questions:

I have two children aged 8 & 9 from a previous marriage. I am in a new relationship and we wish to move to New Zealand with my two children. My ex husband refuses to allow the children to go. my brother lives in NZ and my parents are planning to go also. I will have no family in this teh UK once this happens and desperately want to be with them all. I understand I need a court order, but how do I go about obtaining one and what are the chances of getting one?
Our Son is married to a New Zealand girl and have two children. They moved to NZ 9 years ago and both work. Can my wife and I apply to emmigrate under a sponsership especially as I am 59yrs and my wife age 49yrs?
My boyfriend is a Canadian citizen, moving back in 2 weeks, if i were to follow him over in a month, can i use him as a DeFacto or sponsor

Although I have a degree and a varied working history, I do not qualify for any of the skilled/business visas. My Australian same sex partner and I have not been together for long enough nor lived together so I do not qualify for a spousal visa. My last resort is applying for a 2 yr student visa. If I chose this visa and my partner and i lived together and complied with all the spousal criteria by the end of my 2 yrs there, would i be able to apply direct from australia or would I have to come back to uk? I also would be very interested in buying a house when on my 2 yr student visa- are there any restrictions on buying property when on a student temp visa? and would it be likely to help my case if applying thereafter for a spousal visa? If you cannot help with the question specifically, could you point out anywhere i can find furtehr info on buying property in oz? thanks

You need to speak to a family solicitor. I can put you in touch with a good one. The court order generally is obntainable with good representation.

Comments:You need to meet the requirment for a parent visa. You sponsor being your son should meet sponsorship criteria. But you must meet balance of family criteria and as such all you children are taken into account. Other options could be a skills visa for you wife as the main applicant. Age cut of is 55.

Comments:If you can show a solid 12 months de facto relationship. I.e joint bills, bank accounts, mortages, joint finances, joint property leases.

I have filled in most of my de facto sponsorship form. There is one section where it states that if you have been on holiday etc to Australia and asks for the visa number to be added to the form. This visa number is not in my passport because I presume it was elecronically done. Is this an important item to be added to the form? If so, how do I obtain this visa number? Is it also better to obtain police clearance and indeed medicals before posting the form back? I have had different suggestions regarding this matter and would like to know for sure what is the best thing to do. Also, if all the details entered on the form are correct, how long should it take for my application to be accepted? Thanks

Your situation is quite complex, but no your kids cannot sponsor you but their guardian can, i.e their mother. they must be permanent residents and been resident in Australia for a minimum of 2 years. Ont he basis of the information provided you are not eligible for a temporary visa, except tourist visas. For a full assessment please call or complete an on-line enquiry.

When your children have been in Asutralia for 2 years and are permanent residence they will be eligible to sponsor you under the contributory parent class. Fora full assessment pelase complete an on-line assessment or give us a call.

You only need 12 months cohabitation and then you can apply - either on or off shore. see www.firb.gov.au for house purchases.
