Hello, I am a well qualified and degreed Electrical Engineer with several years expierence for my age; being only 27. I have been saving and planning on obtaining a work visa for Australia for several years now but recently got cited for a DUI. I am going to wait at least a year before I apply for a work visa. Would I still qualify?
If a couple are planning to emigrate to Austrailia with their four children and one of the children has a recent conviction for Arson for which he has received a eighteen month Supervision Order will this be problematic?

Do I need to declare this, given that it seems to have been deleted? If so, will it affect my application?
Hello, if you have a lowest class misdemeanor for harassment in another country other than that of your own and you served no jail time just the minimum fine and some community service do you know if this will affect emigrating to Australia?

Yes - generally you will be accepted with this on your record.

No - it wont mean automatic refusal - but each case is judged on its merits. Youare right to be concerned because a "character based refusal" is a risk. Ususally this is an area I would leave to a pro. e-mail your history to me for appraisal (free of charge) richard@my-oe.com

You cannot go without her - under the "family unit" "one fail all fail" policy. Mild retardation can fail due to future health care/special education costs. speak to an experienced professional (e.g. richard@my-oe.com) who can take a case history, and if required organise a pre application medical opinion. You have a serious chance of failing an application on "health" grounds. Australia have got tougher and tougher on this over the past few years.

A conviction will show only convictions - not warnings. You dont need to declare a caution.

It should not. But each case is judged on its merits and the circumstances will be weighed by a delegate of the minister.

This dealt with on a case by case basis but the answer is yes - you can be refused.

Yes you can be refused. It is likely to have cost implications for your new country with either treatment costs for you or infection risk (and therefore costs) for them. I have got some people a visa with this condition due to the state of the disease within them and their prognosis being very positive. This is not a DIY matter - you need a good agent with experience in this area.

Travel to Oz is no problem but Canadian permanet residence will be a big problem. Any Drunk Driving conviction within the last 5 years will make a refusal probable.
