My boyfriend and i have been together for 1 year in England and are in a stable relationship...however, over the course of the relationship he admitted that his visiting visa ran out in December, therefore making him an alien...he has been working menial jobs, earning enough cash to rent a room and has used no funds from the uk government..He is also fit and Healthy. He has a large amount of family, aunts, uncles and cousins and wishes to stay and build a life over here..To compound the situation he is a Barbadian citizen who was born and raised in the US...but a youth of crime led to him being deported to Barbados a country where he does not know anybody..his mother and brother are in the states...How can this situation be resolved...i love him but do not want to rush marriage.

What is the process for getting sponsored by an employer in Australia? Is this difficuly=t. I am from the U.K and have had a working holiday visa and do not pass the points test.

To Whom It May Concern: I am very confused at the moment... I was under the impression that whilst living in Australia on a SIR (495) Visa, one can apply for a Skilled Independent Visa (136). I however received information this morning that one cannot apply for any other visa whist being on a SIR (495) Visa. My husband and I were thinking of applying for a SIR (495) Visa through South Australia on my qualifications and skills. My husband will only be admitted as a solicitor early 2007 in Australia and we will only be able to apply for a Skilled Independent Visa (136) once he is admitted, as he cannot claim the 60 SOL points before actual admission as a solicitor. In order to get quicker into Australia, we thought that SIR (495) Visa will be ideal if Immigration SA is willing to sponsor us. Based on the fact that the SIR (495) Visa takes approximately 6 months to process, we thought that we will go to Australia once the SIR (495) Visa is approved and then apply for a On-Shore Skilled Independent Visa (136). Was I living in a dream world to think that the above was possible? I tried to obtain more information on this, but had no joy. Is there anyone out there that can give me some guidance? Any help will be appreciated! Pippa!
My boyfriend is coming from okinawa, japan. if we get married will he get a green card? how long will it take for him to get it? since he only has 90 days to say, will that be long enough for him to get one or will he be aloud to stay if he is in the proccess of getting a one?
Our daughter is currently on holiday in South Africa she left on 22 May and due to return on 22 August. She is thinking of extending her visit for 3 more months after that. Can I still nominate her as my dependant on my 457 visa application. She is 18 but currently unemployed (just completed her apprenticeship in child care) and reliant on us financially. She has a CRB Disclosure dated 30 March 2005, would that count as her police check, and would she be able to have her chest xray in South Africa. If all this is possible would she then be able to fly direct from South Africa to Australia, providing we were already there?

You will need an expert, experienced and LOCAL immigration attorney. You will have lots of visits to this persons offices and probabaly a few court hearings. Good luck.

It is theoretically possible - but the employer would have to convince the Department that there is no Australian who can do you job (impossible for a waitress or buss driver etc)

you could apply as a "fiance" but that is a big call... You could also look at what temporary visa options you have - e.g. working holiday etc so that you can get the 12 months living together when you are on that intital visa!

You can be added to his student visa if you prove you have a defacto relationship.

I dont see why you cant do this. I have just checked an SIR grant letter and visa label and it does not say anything about this restriction their. In my opinion you can apply for a 136 while on a 495. The only difficulty would be leaving the country to have the visa evidenced. contact me on richard@my-oe.com to discuss further.

90 dayus is usually NOT enough time to get a visa. It should be arranged pre travel.

The question is whether or not your daghter is dependant on in the eyes of the Australian decision maker. If she is - you can apply to have her on your 457. I would seek some advice from an agent where you are. www.themara.com.au for a listing.
