Questions:
Should we ever emigrate to Australia would we be able to take our tortoises with us. We have 4 African species. If the answer's yes then what would the quarantine period be?

I have just returned from Sydney after 14 years approx being illegal. I left on a bridging visa given by immigration office. I was told that I could not return for one year but when arrived at airport was told three. Obviously I am very confused. Who is correct? I was also told that I could apply to migrate once I had returned to the UK. I ideally would like legal advice on this matter to get the correct information so I do not waste my money and time. I am willing to do whatever is required and the correct way to return and live in Australia legally. Who do I contact and how do I go about this? Awaiting your reply in anticipation.

For information for customs and quarantine periods for animals you will need to contact companies such as Pet Passports, Air Pets and Pet Travel Service. OE Visas are not experts in these matters but our colleagues at these companies are up to date with current requirements for pet travels to Australia. We do not deal with migration to the UK/Scotland so I am unable to answer your UK query. But for NZ there is no assessment under the skills migration route of your financial stability, however with the points requirements for NZ most people require a job offer especially if your occupation is not on their shortages list. |

If you have overstayed your visa you automatically receive a three year ban. This can only be waivered in exceptional circumstances and the only reasons being that by you not obtaining a visa to go back to Australia within three years will adversely affect an Australian Citizen i.e a family member is critically ill, or your spouse is an Australian and wishes to sponsor you. If you wish to have an assessment of your migration options once this three year ban finishes then please contact a member of the OE Visa team directly. |

Yes, bankruptcy will affect a business application to Australia. In answer to your question on what would be your best choice of application, there is no simple answer. It will depend on what your circumstances are and what the migration policies are at the time you wish to apply, both these circumstances change constantly. Yes there are. Generally speaking everybody should inform the Inland Revenue they are leaving the UK and on what date. If you are in receipt of any pension you should also inform the pension provider. There are various other financial type people you should inform you are going if you have ISA's, PEPs etc. We always recommend a financial expert cast an eye over your affairs 3 to 4 months prior to departure and generally try to arrange an introduction to the experts we recommend at our "pre-departure seminars". |

You firstly need to track the application you lodged and prove to the Immigration department that they have received your post. Hopefully you posted your application special class which requires a signature to receive it. If this has been done you can check whether or not they have received your application or not. Also you will have a lodgement fee, can you check whether the payment has been taken? Cashed cheque, money has cleared you account? Normal procedure once Immigration has received an application is to cash the fee and then send an acknowledgment letter. What is the number you gave them? If this is an official file reference number from the immigration department they should be able to find your case on their database. Otherwise they can also do checks by using your full name and date of birth. |

I cannot answer the question on where this leaves you as far as financial support. This is not a matter of Australian immigration law but of UK law. My understanding is if you wanted to take the children to Australia then he is required to give consent, if this is given he is then not required to pay any further support. However if he is the one leaving the law may be the same or he may be still responsible. But if the Child Support Agency is wiping their hands of him I don't think this will help your situation. For Australian Migration law, it is a requirement that all children whether migrating or not undergo a medical exam. This no way allows him to take the children to Australia, written consent from you and signed by your lawyer is required for this. However it eases the migration process if the children undergo the medical, however if you or the children refuse then this information is provided to DIMIA that he has tried to obtain the medicals and in most cases his visa is approved. |

I am currently looking into overseas emigration to Australia. From initial enquiries I will be eligible under the Skilled Migration Visa due to my qualifications. I am currently under contract to serve with my current employer for another 5 years. I will be looking to emigrate therefore in 5 year's time. What will be the best time to commence my application bearing in mind that I won't be able to take up permanent residency for another 5 years. I know the process can take 18-24 months and planning can never be to soon i.e. buying property ect. Any advice will be welcome. *************************************************** The best time to begin your application process is at least 12 to 15 months before you wish to migrate to Australia. However who knows if you will still be eligible in 5 year's time. You will most likely lose 5 points for age so you won’t be sitting on the same points. What will the pass mark be? And how will those points be assessed. The migration process has changed dramatically over the last 5 years and the same is expected over the next 5. If you are committed to migrating I would start the process NOW, given that you meet the migration points test at this point in time. It will take 12 to 18 months to process your application. Say in 18 months your visa is issued it will be valid for 5 years, you will have to activated your visa normally within 10 months of your visa being granted (12 months from the date which you have your police and medical check) so at present you won't have to migrate for another 6 + years, but must travel to Australia on a holiday to activate the visa within the next 2 to 2 ½ years time. |
